Mediante un arduo procedimiento de investigación realizado por los funcionarios del Cicpc, se pudo comprobar que Gutiérrez, ubicaba a niños de 9 y 12 años de edad, indicándoles que les pagaría un dólar a cada uno, por ingresar a las viviendas de la zona y sustraer artículos de valor, así como partes y piezas de vehículos.
Una vez obtiene los objetos, los comercializa lucrándose de manera ilegal; al ser detenido se recuperó una cámara de un motor, un disco y un freno.
También fue verificado en el Sistema de Investigación e Información Policial (Siipol), arrojando como resultado que se encuentra solicitado por el Juzgado Segundo de Control, sección adolescente del Área Metropolitana de Caracas y posee registros por lesiones y robo genérico. Siendo puesto a la orden del Ministerio Público.
