Tres demandas de Odebrecht contra Venezuela quedaron suspendidas este mes de marzo, mientras el Estado mantiene un juicio contra la constructora. Seis años después del estallido del escándalo de sobornos de la empresa brasileña, no hay imputados por corrupción en el sistema judicial venezolano.
Sin explicaciones, el Tribunal Supremo de Justicia (TSJ) anunció en su página web la suspensión «hasta nuevo aviso» de las audiencias de las tres demandas contra el segundo país que más sobornos recibió del gigante de la construcción, unos 98 millones de dólares, según su expresidente Marcelo Odebrecht, condenado a 19 años de cárcel en Brasil.
Esas audiencias estaban pautadas del 10 al 17 de marzo. Obras como el puente Mercosur, que uniría los estados Guárico y Bolívar; un segundo puente sobre el Lago de Maracaibo; y un sistema ferroviario para unir Caracas con las vecinas La Guaira y Guatire, quedaron inconclusas.
Desde una chalana en el río Orinoco o desde un automóvil en la autopista al salir de Caracas, pueden verse los gigantescos pilares de concreto de estos proyectos abandonados. La mayoría fueron convenidos durante el gobierno del fallecido expresidente Hugo Chávez (1999-2013), que estrechó las relaciones con el Brasil de Luiz Inácio Lula da Silva (Lula, 2003-2010) -salpicado también por el escándalo-, en medio de una bonanza petrolera que terminó en 2014, ya con su sucesor, Nicolás Maduro, en el poder.
El escándalo de Odebrecht, que explotó en 2016, involucró a políticos y funcionarios de 12 países de América Latina -incluidos presidentes y expresidentes-, que supuestamente recibieron cientos de millones de dólares en sobornos a cambio de contratos públicos en el continente. Ningún funcionario, en contraste, ha sido imputado en Venezuela.
«Nunca abandonó las obras»
Tras surgir el escándalo, el gobierno venezolano suspendió unilateralmente sus contratos con Odebrecht y allanó sus instalaciones. Maduro asegura que los trabajos fueron «abandonados por Odebrecht de manera ilegal», lo que la constructora niega.
Odebrecht, que se ha convertido en sinónimo de corrupción en el continente y que cambió su nombre a Novonor, exige que se anule la decisión de suspender los contratos y se le permita terminar las obras.
«Es importante aclarar que CNO [Constructora Norberto Odebrecht] nunca abandonó las obras que estaba ejecutando en Venezuela. Lo que ocurrió fue que todos los contratos de obras han sido rescindidos unilateralmente por los diversos clientes estatales», precisó Novonor a la AFP.
Según la ONG Transparencia Venezuela, se produjo «una cesación de los pagos de las valuaciones» en 2016, en un momento de una profunda crisis, lo que «imposibilitó la obra». Esta organización indicó, en 2018, que Odebrecht culminó solo nueve de 33 obras contratadas y que el Estado venezolano había pagado al conglomerado más de 13 mil millones de dólares por 18 de ellas.
La exfiscal general Luisa Ortega Díaz dijo, ya fuera del cargo, que ese monto ascendía efectivamente a 30.000 millones de dólares.
«Tierrita en los ojos»
Maduro ha prometido reiteradamente que terminará los proyectos de la brasileña, aunque todavía no hay un cronograma. «Odebrecht le echaba tierrita en los ojos a uno, como que son los únicos que pueden construir un elevado, una torre, eso lo podemos hacer nosotros», dijo en un acto oficial en septiembre pasado.
De su lado, el ministro de Transporte, Hipólito Abreu, declaró al canal estatal VTV que todas las obras estaban «sin planos, sin diseños», por lo que se inició un trabajo de «ingeniería» y «reingeniería» para completarlas ahora.
En paralelo, mientras las demandas de Odebrecht se suspendieron, sigue en marcha un juicio del estatal Metro de Caracas contra la constructora por el incumplimiento de un proyecto de 2.400 viviendas que tampoco fueron construidas, con 76 millones de dólares de inversión, según indican sentencias del TSJ.
La máxima corte venezolana, cuyo último pronunciamiento sobre el caso fue en septiembre pasado, ha pedido aclaratorias y evalúa pruebas.
El expresidente brasileño Lula llegó a ser condenado por el caso Odebrecht, aunque su pena fue anulada.
El exvicepresidente de Ecuador Jorge Glas y el exministro de Obras de República Dominicana Víctor Díaz Rúa también fueron sentenciados a prisión, así como el exmandatario peruano Ollanta Humala enfrenta un juicio.
Nada parecido ocurre en Venezuela. El fiscal general, Tarek William Saab, dijo en entrevista a la AFP en 2017 que se investigarían denuncias y descartó abrir un expediente contra Maduro, acusado por su predecesora en el Ministerio Público.
