El Tribunal de Apelaciones del estado de Nueva York emitió una sentencia este jueves que anula la condena de violación contra el exproductor de cine Harvey Weinstein, aunque dictaminó que debe realizarse un nuevo proceso.
De acuerdo con Hollywood Reporter, dicho Tribunal indicó que en el juicio celebrado en la ciudad de Nueva York se perjudicó a Weinstein con fallos «inadecuados», incluyendo el llamar como testigos a mujeres sobre acusaciones que no formaban parte del caso.
La sentencia que favoreció a Weinstein contó con cuatro votos a favor y tres en contra, publica Mundo UR.
“Bajo nuestro sistema de justicia, el acusado tiene derecho a rendir cuentas únicamente por el delito imputado y, por lo tanto, no se pueden admitir acusaciones de malos actos anteriores en su contra con el único propósito de establecer su propensión a la delincuencia. La fiscalía tampoco puede utilizar ‘condenas previas o pruebas de la comisión previa de actos específicos, criminales, viciosos o inmorales’ más que para cuestionar la credibilidad del acusado», escribió la jueza Jenny Rivera en su fallo.
Actualmente, Harvey Weinstein está recluido en el Correccional Mohawk de Rome (Nueva York), según el Departamento Estatal de Correccionales y Supervisión Comunitaria.
Weinstein también fue a juicio en Los Ángeles, donde fue declarado culpable en diciembre de 2022 de violaciónn y condenado a 16 años de prisión.
En Nueva York, el exproductor de cine fue declarado culpable en 2020 de acto sexual delictivo en primer grado y violación en tercer grado, y fue condenado a 23 años de prisión.
En 2021, el productor de cine Harvey Weinstein apeló la condena por delitos sexuales que se le impuso en 2020.
Weinstein, que siempre ha defendido su inocencia, argumenta que el juicio en su contra no fue justo, entre otras cosas, porque se permitió testificar a varias mujeres que habían denunciado supuestos abusos a pesar de que en el proceso no se juzgaban esas acusaciones en concreto.
