La estrategia que está utilizando el Estado para mostrar a la comunidad internacional un sistema de justicia eficaz con autonomía e independencia dispuesto a procesar y condenar a los responsables de delitos graves a los DDHH y crímenes de lesa humanidad generó, este viernes, una respuesta del exparlamentario y activista de derechos civiles Rafael Narváez.
El defensor de DD.HH. resaltó que, aunque la AN está legislando en torno a estos delitos, para nadie es un secreto que la impunidad es la que ha prevalecido entre 2014 y 2017, «cuando ocurrieron estos crímenes horrendos en complicidad con los poderes públicos».
«La AN y el sistema de justicia pretenden exonerar de responsabilidad penal a los jefes de los componentes del letal ‘Plan Zamora’ y altos mandos militares que ejecutaron en forma sistemática vulneraciones graves a los DDHH y crímenes de lesa humanidad, aprobando proyectos de ley sobre delitos de genocidio, lesa humanidad y crímenes de guerra que no tendrán efectos retroactivos”, dijo Narváez.
Agregó que la CPI continuará su investigación de forma autónoma e independiente como lo establece el Estatuto de Roma, “sin dejar de observar el cumplimiento del memorándum de entendimiento firmado con el fiscal Karim Khan”.
Condenas “insignificantes”
El coordinador por los derechos civiles fustigó nuevamente al sistema de justicia porque solo ha condenado a oficiales subalternos pero no ha señalado a altos funcionarios de alto rango y mandos militares. “Olvidan que la CPI sólo procesa por crímenes de lesa humanidad a funcionarios de alto nivel, altos mandos militares y jefes de Estado en ejercicio”.
El abogado penalista rechazó la decisión del Poder Judicial de emitir una condena “insignificante” contra funcionarios del Servicio Bolivariano de Inteligencia (Sebin), con lo que se burla del dolor, el sentimiento de los familiares y del Código Penal, al establecer penas de cinco años por homicidio.
