Un grupo de expertos designados por la Organización de Estados Americanos (OEA) instó este viernes a la Corte Penal Internacional (CPI) a que actúe de inmediato «para promover la justicia y la rendición de cuentas en Venezuela».
Así lo expresó el panel de expertos en un comunicado, donde mencionó un informe elaborado por la exfiscal de la CPI Fatou Bensouda.
El mes pasado, la Fiscalía de la CPI publicó un documento, con fecha 15 de junio -día en que terminó su labor Bensouda- y con nota de «documento clasificado» hasta el 10 de agosto; que concluye que «hay una base razonable para creer que delitos que competen a la jurisdicción de la Corte se han cometido en Venezuela».
En el informe, Bensouda considera que, de acuerdo a la información de la que dispuso, tiene «una base razonable» para creer que desde abril de 2017 «autoridades civiles; miembros de las Fuerzas Armadas e individuos pro Gobierno han cometido crímenes de lesa humanidad».
Entre esos delitos citó el encarcelamiento «u otros tipos de severa privación de la libertad física en violación de las normas fundamentales del derecho internacional»; la tortura y la «violación u otras formas de violación sexual», así como la persecución por motivos políticos.
El panel de expertos de la OEA consideró que es necesario que la CPI actúe lo antes posible, «dado que no se ha realizado ningún progreso significativo desde las conclusiones confidenciales de la fiscal saliente».
Asimismo subrayó que el documento redactado por Bensouda corrobora las conclusiones a la que el propio panel llegó en un informe presentado en mayo de 2018 sobre «la existencia de crímenes de lesa humanidad en Venezuela y el cumplimiento con los requisitos para la apertura de una investigación».
A principios de agosto, el fiscal general de Venezuela, Tarek Saab, acusó a la OEA de «interferir» en el examen preliminar del que el país fue objeto ante la CPI.
«El Ministerio Público de la República Bolivariana de Venezuela ha tomado nota sin sorpresa de la nueva tentativa de la OEA y de sus autoproclamados ‘expertos independientes’ de influir en la Fiscalía de la Corte Penal Internacional»; expresó Saab en un comunicado publicado en su cuenta de Twitter.
El panel fue designado en 2017 por el secretario general de la OEA, Luis Almagro.
El mes pasado, el grupo de expertos exigió a la CPI que se abriera una investigación; sobre lo que debe decidir el fiscal Karim Khan, que sustituyó en el cargo a Bensouda, el pasado 15 de junio.
