El presidente Nayib Bukele confirmó el viernes que va a romper el convenio de cooperación con la Comisión Internacional Contra la Impunidad en El Salvador, ya que considera que no se puede confiar en la OEA porque contrató a un exalcalde capitalino que está siendo procesado.
Bukele se quejó de que el secretario general de la Organización de los Estados Americanos, Luis Almagro, anunciara la contratación del exalcalde Ernesto Muyshondt en el papel de asesor, un día antes de que éste asistiera a un juzgado para una audiencia de revisión de medidas por supuestamente haber incumplido órdenes judiciales. Muyshondt enfrenta cargos de fraude electoral y negociaciones con las pandillas.
“Hemos decidido que vamos a romper nuestro convenio con la CICIES porque es un despropósito que intentemos combatir la impunidad con precisamente las personas que están promoviendo la impunidad en El Salvador”, dijo el mandatario en conferencia de prensa en la Casa Presidencial.
“(Almagro) le intenta brindar impunidad (a Muyshondt) y sabía que lo íbamos a arrestar”, agregó.
El mandatario salvadoreño dijo que su gobierno quiere combatir la impunidad, pero como ya no pueden confiar en la OEA, “vamos a buscar alguna organización internacional, otra distinta, para que nos acompañe en la creación de una CICIES que sí combata la impunidad”.
Más temprano, el fiscal general, Rodolfo Delgado, informó que pondrá fin al convenio de cooperación luego de conocer que Almagro incorporaría al exalcalde capitalino a su grupo de trabajo.
En conferencia de prensa, Delgado dijo que la cooperación entre la Fiscalía y la CICIES finalizará en 30 días, y que solicitará a la cancillería salvadoreña que se anule ese convenio “porque aquí estamos abiertos a trabajar con la comunidad internacional y recibir apoyo para el combate a la impunidad, pero no es posible recibir este tipo de apoyo por parte de una organización que ahora tiene la asesoría de un delincuente”.
Muyshondt era procesado en libertad junto a otras seis personas por los delitos de fraude electoral y agrupaciones ilícitas al supuestamente haber negociado con las pandillas para que, a cambio de dinero, los apoyaran a ganar las elecciones presidenciales de 2014. Finalmente los comicios los ganó el excomandante guerrillero Salvador Sánchez Cerén.
El mismo viernes, el exalcalde asistió a un juzgado para una audiencia de revisión de medidas, y al concluir la Fiscalía informó que se decretó arresto domiciliar contra él, por lo que tendría que usar un brazalete electrónico y no podría salir del país. Más tarde, cuando Muyshondt salía del juzgado para cumplir el arraigo familiar, la Policía Nacional Civil (PNC) lo capturó.
“Hemos detenido por un nuevo delito al exalcalde de San Salvador, quien está siendo acusado de apropiación indebida de retenciones o percepciones tributarias en perjuicio de la Hacienda Pública”, dijo la PNC.
Horas antes, al llegar al tribunal, Muyshondt dijo que la ruptura de la Fiscalía con la CICIES pretendía “seguir blindando a sus funcionarios para lograr más opacidad y más falta de transparencia en el manejo de los fondos públicos. Sólo buscaban una excusa para seguir haciendo la corrupción que han estado haciendo”. El exalcalde se considera un “perseguido político”.
Entre los procesados con Muyshondt por supuesto fraude electoral y agrupaciones ilícitas figura Benito Lara, exministro de Justicia y Seguridad Pública; el exministro de Gobernación Arístides Valencia, así como el exmediador de la tregua entre pandillas, el excomandante guerrillero Raúl Mijango, y el columnista Paolo Luers.
En este caso también está bajo la lupa el expresidente de la Asamblea Nacional y exdiputado Norman Quijano, del partido Alianza Republicana Nacionalista (Arena). Quijano salió del país el 30 de abril cuando faltaban pocas horas para que llegara a su fin el periodo legislativo para el que fue electo y el fuero constitucional que impedía que las autoridades lo capturaran. Un juez salvadoreño pidió a la oficina de la Interpol en el país que emitiera una difusión roja para buscarlo. La orden de captura pide que sea procesado por los delitos de fraude procesal y agrupaciones ilícitas.
Tras el anuncio de Delgado sobre la ruptura con la CICIES, la embajada de Estados Unidos en El Salvador lamentó en un tuit la situación y dijo que “la lucha contra la corrupción es esencial y fundamental. Vamos a seguir buscando la forma de reducir y combatir la corrupción e impunidad”.
En noviembre de 2019, la OEA y el gobierno de El Salvador firmaron un acuerdo para la creación de la CICIES, y en diciembre de ese año la Fiscalía y la nueva comisión suscribieron un convenio de cooperación y asistencia técnica para fortalecer las capacidades de la Fiscalía en pro de combatir la impunidad y la corrupción en la función pública. Dicha asistencia consistiría en asesoramiento, recomendaciones y transferencias de conocimientos especializados en casos concretos de corrupción por medio de capacitación y formación de los fiscales en el ejercicio de sus funciones.
