La defensa del empresario colombiano Álex Saab, presunto testaferro de Nicolás Maduro, detenido en Cabo Verde desde junio de 2020, presentó hoy denuncias contra tres jueces y contra el fiscal general del país africano por “violar” sus derechos en múltiples ocasiones.
Estas denuncias se añaden a las ya presentadas la semana pasada también contra José Landim, el fiscal general caboverdiano, y contra tres inspectores de la policía judicial que intervinieron en su detención.
Saab denunció ante el Consejo Superior de la Magistratura de Cabo Verde a tres magistrados del Tribunal de Apelación de Barlavento por cometer “numerosos errores procesales” que llevaron a la aprobación de la petición de extradición de Estados Unidos contra el empresario, según la defensa.
Los letrados aseguran, por ejemplo, que “se excedió el tiempo para la detención provisional en la cárcel durante alrededor de cien días”.
Respecto a Landim, la defensa de Saab alega, entre otras acusaciones, que presentaron ante la fiscalía general “varias denuncias de tortura, perjurio y ocultación de pruebas”, unos delitos que, meses después, aseguran, no se investigaron todavía.
Tras la decisión que tomó el año pasado el Tribunal de Apelación de Barlavento, Saab presentó primero un recurso ante el Tribunal Supremo de Cabo Verde que acabó, no obstante, ratificando esa sentencia el pasado 17 de marzo- y, después, en julio, un recurso de amparo ante el Tribunal Constitucional (TC) de la nación isleña.
El pasado 13 de agosto, el TC celebró una vista clave para evaluar tanto este recurso de amparo como una solicitud que defiende la inconstitucionalidad de la detención de Saab.
El tribunal, sin embargo, no reveló en esa misma jornada su decisión y anunciará su veredicto durante los próximos días.
Durante esa vista, la defensa de Saab pidió que se tenga en cuenta el carácter político de las acusaciones que, según el abogado Geraldo Almeida, “quedó claramente demostrado durante todo el proceso”, algo que contradice la Constitución caboverdiana, que prohíbe cualquier extradición por motivos políticos.
En cuanto a las denuncias presentadas la semana pasada ante la fiscalía caboverdiana, la defensa atribuye al fiscal y a los inspectores una “ofensa considerada contra la integridad física, tortura y tratos crueles, degradantes o inhumanos, robo de la propiedad personal, abuso de poder, atentado contra autoridades extranjeras, corrupción pasiva y secuestro”.
El arresto y las acusaciones contra Saab
Saab fue detenido el 12 de junio de 2020 cuando su avión hizo escala en el Aeropuerto Internacional Amílcar Cabral de la isla caboverdiana de Sal, en cumplimiento de una petición de Estados Unidos a través de Interpol, pero la defensa alega que esa alerta se emitió después del arresto.
Tras su detención, Venezuela aseveró también que Saab es un ciudadano venezolano y un “agente” del Gobierno, que se hallaba “en tránsito” en Cabo Verde, por lo que sus abogados argumentan que “tenía derecho a la inviolabilidad personal como enviado especial de Venezuela”.
El nombre del empresario, de 49 años, apareció en los medios cuando la exfiscal venezolana Luisa Ortega Díaz lo acusó en 2017 de ser uno de los testaferros del presidente venezolano.
Saab, nacido en la ciudad colombiana de Barranquilla y de origen libanés, está relacionado con varias empresas, entre ellas Group Grand Limited (GGL), acusada de suministrar alimentos y víveres con sobreprecio al Gobierno de Maduro.
Según el Gobierno estadounidense, el empresario colombiano y tres hijastros de Maduro se lucraron de estas operaciones con “cientos de millones de dólares”.
