La Corte Penal Internacional no abrirá una investigación en torno a las acusaciones de que el expresidente boliviano Evo Morales y sus simpatizantes cometieron crímenes de lesa humanidad al montar bloqueos carreteros que evitaban que los habitantes de una de las naciones más pobres de Latinoamérica tuvieran acceso a ayuda médica vital durante la pandemia del coronavirus, anunció el lunes el fiscal del organismo.
Bolivia pidió en 2020 a la corte internacional que abriera una investigación sobre los bloqueos, asegurando que Morales y otras personas llevaron a cabo ataques organizados y sistemáticos contra la población de Bolivia al “impedir (a la población civil de esas ciudades) que accedan a los insumos y servicios de salud pública”.
La solicitud de Bolivia indicaba que los bloqueos tuvieron “consecuencia directa de provocar la muerte en varias personas y zozobra en el resto de la población ante la posibilidad de morir sin poder ser atendidos en hospitales públicos, o en condiciones que les permitan acceder a insumos médicos, tratamientos y, sobre todo, oxígeno medicinal”.
La solicitud por escrito argumentaba que la campaña equivalía a crímenes contra la humanidad por homicidio y acciones inhumanas.
Sin embargo, el fiscal de la Corte Penal Internacional (CPI) Karim Khan señaló el lunes que la pesquisa preliminar estableció que los eventos no cumplían con los criterios legales de crímenes contra la humanidad según el tratado fundador de la corte, el Estatuto de Roma.
“De conformidad con mi mandato, mi función no consiste en emitir un juicio sobre el contexto político en el que tuvieron lugar los presuntos incidentes, sino determinar, a través de una evaluación independiente, imparcial y objetiva, si éstos constituyen crímenes contemplados en el Estatuto de Roma”, señaló Khan.
“He llegado a la conclusión de que no es ese el caso”, añadió.
Las autoridades bolivianas podrían solicitar una revisión judicial de la decisión de Khan.
Morales, el primer presidente indígena del país, renunció en 2019 ante la intensa presión del ejército y la policía en medio de protestas multitudinarias y disturbios por acusaciones de que intentaba reelegirse de forma fraudulenta. Se exilió, primero en México y posteriormente en Argentina.
Morales regresó a Bolivia a finales de 2020 después de que uno de sus aliados, el exministro de Economía Luis Arce, asumiera la presidencia tras ganar los comicios con el 55 % del voto nacional. El Movimiento al Socialismo, partido de Morales, también retuvo la mayoría en el Congreso en esas elecciones.
