El largo litigio entre el presidente Nicolás Maduro y Juan Guaidó sobre quién puede decidir el destino de 32 toneladas de oro venezolano depositadas en el Banco de Inglaterra quedó este miércoles visto para sentencia en la Corte Suprema británica.
«Se nos ha encomendado un exigente trabajo de examen. Nos llevará algún tiempo considerar todos los argumentos y emitir nuestro juicio», afirmó el presidente de la corte, Lord Robert Reed, en el tercer y último día de vistas.
Pese a que los cinco jueces había previsto cuatro días de audiencias en este caso de gran tecnicismo jurídico, basado en la interpretación de la ley, sin expertos ni testigos, el miércoles habían oído todos los argumentos.
«No sabemos cuándo será la sentencia en esta fase, pero a menudo puede ser varios meses después de la celebración de la vista», precisó a la AFP una portavoz del tribunal.
Los magistrados escucharon al abogado del ministerio británico de Relaciones Exteriores reafirmar que el gobierno reconoce a Guaidó como presidente encargado de Venezuela «a todos los efectos». «Maduro, en cambio, no es reconocido a ningún efecto (…) ni respecto a sus actos en Venezuela ni respecto a sus actos en el plano internacional», subrayó Sir James Eadie.
Por lo tanto, defendieron los abogados del líder opositor, un tribunal inglés no tiene jurisdicción para cuestionar los nombramientos por él realizados, aunque estos hayan sido invalidados por la justicia de Venezuela.
Tras autoproclamarse presidente encargado y haber sido reconocido como tal por medio centenar de países, Guaidó nombró en julio de 2019 a su propia dirección paralela del Banco Central de Venezuela.
Estos nombramientos fueron inmediatamente invalidados por el Tribunal Supremo venezolano, leal a Maduro. Pero eso no le impidió dirigirse al Banco de Inglaterra afirmando ser el representante legítimo del país y pedirle que no entregase al gobierno los lingotes, valorados en más de mil millones de dólares, que custodia en sus cámaras acorazadas.
Los abogados del gobierno bolivariano se esforzaron por persuadir a los jueces de que «este caso se refiere esencialmente a asuntos internos de Venezuela» donde el poder de facto está en manos de Maduro.
Hace un año, un juez de lo mercantil de Londres impidió a la administración chavista acceder al oro, el que dice necesitar para combatir la pandemia de coronavirus.
Pero el tribunal de apelaciones inglés anuló esta decisión en octubre, considerando que el ejecutivo de Boris Johnson podía reconocer «de facto» el poder de Maduro, con cuya administración sigue manteniendo relaciones diplomáticas.
