El organismo confirmó que cuenta con el material probatorio suficiente para vincular a los uniformados con los hechos.
Luego de los polémicos sucesos acontecidos el pasado viernes 28 de mayo en el barrio Ciudad Jardín de Cali, donde varios videos compartidos por la comunidad dejaron en evidencia que civiles dispararon contra un grupo de manifestantes, la Policía Nacional anunció que iniciaría las respectivas investigaciones contra los uniformados y ciudadanos involucrados.
Con ello, la Unidad Administrativa Especial de la Justicia Penal Militar y Policial confirmó este sábado 5 de junio que abrió una indagación preliminar tras los citados hechos y que vinculan, de momento, a siete miembros de la policía, puesto que se recopiló el material probatorio y la evidencia física necesaria para que sean juzgados por el presunto delito de prevaricato por omisión.
“La Unidad Administrativa Especial de la Justicia Penal Militar y Policial informa que, frente a los videos que han circulado en redes sociales sobre hechos ocurridos el día 28 de mayo de 2021, en los cuales se observan civiles haciendo uso de armas en presencia de uniformados de la Policía en el sector Ciudad Jardín de Cali, un Juzgado de Instrucción Penal Militar y Policial inició indagación preliminar, y luego sumario, radicado bajo No. 4293″, comunicó la Unidad.
Continuidad del proceso de la Dijín:
A raíz de estos hechos, el general Fernando Murillo, comandante de la Dijín, anunció hace algunos días que 10 policías habían sido plenamente identificados y a los cuales se les abriría una investigación para esclarecer si hubo omisión o cualquier otra conducta indebida.
“Es un mal procedimiento de la Policía. Cada policía debe explicar por qué actuó de esa forma sabiendo que no corresponde a las directrices institucionales. […] Esperamos que en las declaraciones ellos puedan explicar por qué no se actúo en el marco legal frente a de unos particulares que salieron con armas”, indicó entonces Murillo.
Además, el comandante de la Dijín precisó que las pesquisas quedarían en manos de las autoridades competentes: “Ya inicia la justicia penal militar a tomar cada una de las declaraciones. El trabajo de la Dijín fue poder identificar cuáles eran los funcionarios en el lugar. A partir de hoy con esas declaraciones, cada uno responderá por su actuación que es reprochable desde todo punto de vista”.
Caso de Andrés Escobar:
La Dijín también indicó que logró identificar a cinco civiles que habrían estado armados en los disturbios de ese 28 de mayo, por lo que su accionar es materia de investigación. Este grupo de individuos serán “llamados para aclarar la situación. Deberá establecerse si las armas que usaron eran de fogueo o de fuego, para saber cómo se debe proceder, si con una contravención o con una acción penal”, dijo el comandante Murillo en declaraciones recogidas por el diario El País de Cali.
Uno de los casos que más ruido hizo fue el que la Fiscalía General abrió contra Andrés Escobar, el empresario que fue identificado en los videos compartidos en redes sociales accionando un “arma de fogueo”. Según se pronunció el propio ciudadano en la web, el arma que portaba tenía los papeles de importación de la Dian y se encontraba en regla. Además, manifestó que la utilizó para defender a los policías que estaban siendo agredidos por un grupo de “vándalos” en el CAI de Ciudad Jardín
“Me tildan de asesino, de genocida y una cantidad de barbaridades que no soy. No solo he recibido esas amenazas yo sino también mi familia (…) se ve mi cara en las fotos. Yo no soy ningún paramilitar, tengo la cara limpia, aporto a la sociedad con empleo, hago labor social, pago impuestos”, expresó Escobar en redes.
